These terms and conditions apply to all orders, purchases and agreements via the Final Kilo webshop.
In these terms and conditions the following definitions apply: Final Kilo: the webshop of Athletic Development B.V. Entrepreneur: Athletic Development B.V., trading under the name Final Kilo. Customer: any natural or legal person who places an order via the webshop. Consumer: a customer acting for purposes outside their business or professional activity. Product: any cosmetic product or other item offered via the Final Kilo webshop. Agreement: the purchase agreement between Final Kilo and the customer. Webshop: the online store at www.finalkilo.nl.

These terms apply to every offer by Final Kilo and to every agreement concluded via the webshop. By placing an order, the customer agrees to these terms. Deviations are only valid when confirmed in writing by Final Kilo.
Final Kilo does its best to describe all products as clearly and completely as possible. Images, colors and packaging may differ slightly from the actual product. Minor deviations do not entitle the customer to compensation or cancellation, unless the product is materially different than described. Final Kilo reserves the right to change the offer, prices and product information at any time. Product information on the webshop is intended as general product information and may not be regarded as medical advice.
The agreement is concluded when the customer places an order and it is confirmed by Final Kilo. Final Kilo may refuse or cancel an order in case of an obvious error, incorrect price, incorrect stock status, suspicion of abuse, fraud or other circumstances making delivery reasonably impossible.
All prices on the webshop are shown in euros and include VAT, unless stated otherwise. Any shipping costs are clearly shown during checkout. The customer must pay via the payment methods offered on the webshop. An order is only processed after payment has been successfully received.
Final Kilo processes and ships orders Monday to Friday between 09:00 and 17:00. Orders placed on business days before 12:00 we aim to process the same day. Later orders are usually processed the next business day. Delivery times are indicative. Carrier delays do not automatically entitle to compensation. Final Kilo does not ship to PO boxes, hotels, motels, resorts, schools, transport companies or forwarding addresses. The customer is responsible for entering a correct and complete delivery address. If a package cannot be delivered due to incorrect or incomplete address details, additional costs may be charged to the customer.
If a package is delivered damaged or appears lost, the customer should contact Final Kilo as soon as possible. Final Kilo may then start an investigation with the carrier. The customer must cooperate and provide all necessary information, such as photos of damage, packaging or shipping label. Final Kilo will work with the customer to find a suitable solution.
Consumers have the right to withdraw an order within 14 days of receipt without giving a reason, unless a legal exception applies. After notifying withdrawal, the customer has another 14 days to return the product. During the cooling-off period the customer must handle the product and packaging with care, and may only inspect the product as they would in a physical store.
Due to hygiene and health protection, certain products cannot be returned once the seal is broken. The right of withdrawal lapses when: the product is unsuitable for return for hygiene or health reasons; the product was delivered sealed; and the seal has been broken after delivery. Opened, used, damaged or incomplete products will not be accepted as returns.
A customer wishing to return a product must always first contact Final Kilo via info@finalkilo.nl. A return is only accepted when the product: is unused; is unopened; is in the original packaging; is complete; is undamaged; and meets the return conditions. The customer must always include the order number, packing slip or invoice with the return. Products returned without prior contact may not be processed correctly.
The cost of returning an order is borne by the customer, unless Final Kilo has agreed otherwise in writing in advance. Final Kilo recommends always shipping returns with tracking. The customer is responsible for the return shipment until it has been received by Final Kilo.
Once Final Kilo has received and checked the return in good condition, the refund is processed via the original payment method. Final Kilo may wait to refund until the product has been received or until the customer has shown that the product has been returned. When the entire order is withdrawn, the standard outbound shipping costs are also refunded. Any extra costs for a more expensive shipping method are not refunded. The refund is processed no later than 14 days after receipt of the withdrawal notice, provided the product has been received or the customer has provided proof of return shipment.
An order can be cancelled free of charge as long as it has not yet been processed or shipped. If the order has already been processed or shipped, the customer can use the return procedure after receipt, provided the product meets the return conditions. When cancelling, the customer must always state the order number.
Final Kilo products are cosmetic products and are intended for external use only. Always use products according to the instructions on the packaging and the information on the webshop. Avoid contact with eyes, mucous membranes, open wounds and irritated skin, unless otherwise stated on the product. Stop using in case of irritation, redness, itching, burning sensation or any other unwanted skin reaction. Do not use the product if you are allergic to any of the ingredients. In case of doubt about use, allergies, skin reactions, pregnancy, medical complaints or medication, the customer must first seek advice from a doctor or specialist. Product information on the webshop is not intended to diagnose, treat, cure or prevent any disease, condition or physical complaint. Final Kilo is not liable for damage caused by incorrect use, improper use, excessive use, allergic reactions or use contrary to the instructions.
Final Kilo does its best to present product information carefully, clearly and honestly. Claims about cosmetic products relate exclusively to care, appearance, scent, feel, user experience or support of normal skincare. Product texts, images, reviews and marketing expressions may not be interpreted as medical claims or as a guarantee of a specific result. Results may vary from person to person.
Final Kilo is not liable for indirect damage, consequential damage, loss of profit, missed savings, physical complaints or damage caused by incorrect use of products. Final Kilo's liability is, as far as legally permitted, limited to the amount the customer paid for the relevant product. This limitation does not apply if the damage is the result of intent or gross negligence by Final Kilo.
Complaints about products, delivery or service can be reported by email: info@finalkilo.nl. Always include the order number and a clear description of the problem. For complaints about a cosmetic product, such as a skin reaction or damaged product, we ask for clear photos and a description of usage. Final Kilo aims to respond substantively to complaints as soon as possible and at the latest within 14 days.
Final Kilo is not obliged to perform its obligations when prevented by force majeure. Force majeure includes among others: carrier delays, strikes, outages, fire, government measures, extreme weather conditions, illness, stock problems or other circumstances beyond Final Kilo's control.
Final Kilo processes personal data only insofar as necessary for processing orders, payments, shipping, customer service and legal obligations. More information about the processing of personal data can be found in Final Kilo's privacy statement.
All texts, images, logos, product photos, brand names, designs and other content on the webshop are owned by Final Kilo or used with permission of the rights holder. It is not permitted to copy, distribute, modify or commercially use content from the webshop without prior written permission from Final Kilo.
Dutch law applies to all agreements, orders and disputes. Disputes are preferably resolved by mutual consultation. If this is not possible, the dispute can be submitted to the competent court in the Netherlands.
